Nghị định số 82/2015/NĐ-CP ngày 24 tháng 9 năm 2015 về việc miễn thị thực cho người Việt Nam định cư ở nước ngoài và người nước ngoài là vợ, chồng, con của người Việt Nam định cư ở nước ngoài hoặc của công dân Việt Nam.

Giấy miễn thị thực có thời hạn tối đa không quá 05 năm và ngắn hơn thời hạn sử dụng của hộ chiếu hoặc giấy tờ có giá trị đi lại quốc tế của người được cấp ít nhất 06 tháng.

Người đề nghị cấp/cấp lại giấy miễn thị thực đang cư trú ở nước ngoài nộp 01 bộ hồ sơ theo quy định nêu trên tại cơ quan có thẩm quyền cấp thị thực của Việt Nam ở nước ngoài.

1. Cở sở pháp lý

Nghị định số 82/2015/NĐ-CP ngày 24 tháng 9 năm 2015 về việc miễn thị thực cho người Việt Nam định cư ở nước ngoài và người nước ngoài là vợ, chồng, con của người Việt Nam định cư ở nước ngoài hoặc của công dân Việt Nam

2. Thời hạn, giá trị và hình thức của Giấy miễn thị thực

Giấy miễn thị thực gồm 02 loại sau đây:

- Loại dán: Giấy miễn thị thực được dán vào hộ chiếu nước ngoài của người Việt Nam định cư ở nước ngoài và người nước ngoài dùng để nhập cảnh Việt Nam.

- Loại sổ: Giấy miễn thị thực dành cho người Việt Nam định cư ở nước ngoài chỉ có giấy thường trú do nước ngoài cấp và người sử dụng hộ chiếu của những nước, vùng lãnh thổ mà Việt Nam không có quan hệ ngoại giao.

Giấy miễn thị thực có thời hạn tối đa không quá 05 năm và ngắn hơn thời hạn sử dụng của hộ chiếu hoặc giấy tờ có giá trị đi lại quốc tế của người được cấp ít nhất 06 tháng.

Giấy miễn thị thực được cấp cho người nhập cảnh Việt Nam thăm thân, giải quyết việc riêng.

Giấy miễn thị thực được cấp vào hộ chiếu; các trường hợp sau đây được cấp rời (dạng sổ):

a) Hộ chiếu đã hết trang cấp thị thực

b) Hộ chiếu của nước chưa có quan hệ ngoại giao với Việt Nam

c) Giấy tờ có giá trị đi lại quốc tế

d) Theo đề nghị của người được cấp giấy miễn thị thực

e) Vì lý do ngoại giao, quốc phòng, an ninh.

Giấy miễn thị thực được cấp riêng cho từng người. Trẻ em có chung hộ chiếu với cha hoặc mẹ được cấp Giấy miễn thị thực chung với cha hoặc mẹ

3. Hồ sơ đề nghị cấp Giấy miễn thị thực

a. Đối với người Việt Nam định cư ở nước ngoài, hồ sơ gồm:

01 Tờ khai (theo mẫu);

02 tấm ảnh màu mới chụp cỡ 4x6 cm, phông nền trắng, mặt nhìn thẳng, đầu để trần, không đeo kính màu (01 tấm ảnh dán vào Tờ khai, 01 tấm ảnh để rời);

Hộ chiếu nước ngoài hoặc giấy tờ có giá trị đi lại quốc tế hoặc giấy tờ cho phép thường trú do cơ quan có thẩm quyền của nước ngoài cấp còn thời hạn ít nhất 01 năm (kèm theo bản chụp để cơ quan có thẩm quyền cấp Giấy miễn thị thực lưu hồ sơ);

Giấy tờ chứng minh thuộc diện cấp Giấy miễn thị thực (nộp bản sao được chứng thực từ bản chính hoặc kèm theo bản chính để đối chiếu), nếu có:
     

- Giấy chứng nhận có quốc tịch Việt Nam;


- Bản sao hoặc bản trích lục Quyết định cho trở lại quốc tịch Việt Nam;

- Bản sao hoặc bản trích lục Quyết định cho thôi quốc tịch Việt Nam;


- Giấy xác nhận mất quốc tịch Việt Nam;


- Hộ chiếu Việt Nam (còn hoặc đã hết giá trị);


- Giấy chứng minh nhân dân (còn hoặc đã hết giá trị);


- Giấy khai sinh;


- Thẻ cử tri mới nhất;


- Sổ hộ khẩu;


- Sổ thông hành cấp trước 1975;


- Thẻ căn cước cấp trước 1975;

- Tờ trích lục Bộ giấy khai sanh cấp trước 1975;


- Giấy tờ do cơ quan có thẩm quyền của nước ngoài cấp nếu trong đó có ghi người được cấp giấy tờ đó có quốc tịch gốc hoặc gốc Việt Nam.

b. Đối với người nước ngoài là vợ, chồng, con của công dân Việt Nam hoặc người Việt Nam định cư ở nước ngoài, hồ sơ gồm:

01 Tờ khai (theo mẫu);

02 tấm ảnh màu mới chụp cỡ 4x6 cm, phông nền trắng, mặt nhìn thẳng, đầu để trần, không đeo kính màu (01 tấm ảnh dán vào Tờ khai, 01 tấm ảnh để rời);

Hộ chiếu nước ngoài hoặc giấy tờ có giá trị đi lại quốc tế còn thời hạn ít nhất 01 năm (kèm theo bản chụp để cơ quan có thẩm quyền lưu hồ sơ);

Một trong những giấy tờ chứng minh quan hệ vợ, chồng, con với người Việt Nam định cư ở nước ngoài sau đây (nộp bản sao được chứng thực từ bản chính hoặc kèm theo bản chính để đối chiếu):
      

- Giấy đăng ký kết hôn;
      

- Giấy khai sinh;
      

- Giấy xác nhận quan hệ cha, mẹ, con;
      

- Các giấy tờ khác có giá trị theo quy định của pháp luật Việt Nam;
      

- Quyết định nuôi con nuôi.

4. Cấp lại Giấy miễn thị thực

a. Trường hợp bị mất, bị hỏng, hết hạn hoặc có nhu cầu điều chỉnh nội dung trong Giấy miễn thị thực được cấp lại Giấy miễn thị thực.

b. Hồ sơ đề nghị cấp lại Giấy miễn thị thực gồm:

Hộ chiếu nước ngoài hoặc giấy tờ có giá trị đi lại quốc tế hoặc giấy tờ cho phép thường trú do cơ quan có thẩm quyền của nước ngoài cấp còn giá trị ít nhất 01 năm (kèm theo bản chụp để cơ quan có thẩm quyền cấp Giấy miễn thị thực lưu hồ sơ);

01 Tờ khai (theo mẫu);

2 tấm ảnh màu mới chụp cỡ 4x6 cm, phông nền trắng, mặt nhìn thẳng, đầu để trần, không đeo kính màu (01 tấm ảnh dán vào Tờ khai, 01 tấm ảnh để rời);

Trường hợp Giấy miễn thị thực bị mất cần nộp thêm đơn báo mất.

Bản sao được chứng thực từ bản chính, hoặc kèm theo bản chính để đối chiếu, của giấy tờ chứng minh nội dung cần điều chỉnh trong giấy miễn thị thực.

5. Nộp hồ sơ đề nghị cấp/cấp lại giấy miễn thị thực

Người đề nghị cấp/cấp lại giấy miễn thị thực đang cư trú ở nước ngoài nộp 01 bộ hồ sơ theo quy định nêu trên tại cơ quan có thẩm quyền cấp thị thực của Việt Nam ở nước ngoài.

6. Thời hạn cấp Giấy miễn thị thực

Trong thời hạn 01 ngày làm việc kể từ ngày nhận đủ hồ sơ, cơ quan có thẩm quyền cấp thị thực của Việt Nam ở nước ngoài chuyển thông tin của người đề nghị cấp Giấy miễn thị thực về Cục Quản lý xuất nhập cảnh.

Trong thời hạn 03 ngày làm việc, Cục Quản lý xuất nhập cảnh xem xét, trả lời cơ quan có thẩm quyền cấp thị thực của Việt Nam ở nước ngoài.

Trong thời hạn 01 ngày làm việc kể từ khi nhận được thông báo của Cục Quản lý xuất nhập cảnh, cơ quan có thẩm quyền cấp thị thực của Việt Nam ở nước ngoài cấp Giấy miễn thị thực.

7. Lệ phí

Người được cấp, cấp lại giấy miễn thị thực phải nộp lệ phí theo quy định của pháp luật về phí và lệ phí.

Không thu phí xử lý hồ sơ cấp Giấy miễn thị thực đối với các hồ sơ được CQĐD tiếp nhận từ ngày 23/11/2015.

  • Requirements for Belarusian getting visa Vietnam - (29/10/2012)

    Does Belarus Citizens Need Visa for Entering Vietnam or Not?

    Good news !!!! Citizens of Belarus will be exempted from time-limit visas into Vietnam as from July 1, 2015. The policy will be effective for five years from July 1, 2015 to June 30, 2020. 

    Under a resolution just issued by Vietnam government, visitors from Belarus are allowed to enter and stay in Vietnam for up to 15 days without visas regardless of passport types and purpose of visit. Please note that, 30 days after exit Vietnam then you can re-enter with visa free policy, otherwise you need to apply for a visa.
